Definition: The sending of nude pictures of yourself in a text message to your friends and family. It seems to be popular at all ages levels starting at 12 years or so according to an article I read. But does that mean the two girls 14 and 15 who were arrested should be charged with child porn for sending a booby shot to their friends? Should their friends be charged with kiddy porn for receiving those pictures weather they wanted them or not? Would you ever: Pose in the nude for someone? Take a nude picture of yourself? Send a sexy text or picture message? What would be the penalty in your country or state? |

I believe the penalty here would be the same, those who received it would be charged if caught with it and the ones who sent it also arrested. Do I agree? Not entirely. If they choose to take those kinds of pictures of themselves and send them to people they know, then that is a personal matter between the people involved, however it all depends on who it is being sent to. I would consider what they did indecent exposure in certain instances. As for the ones who had it in possession and were arrested, that as far as I can see is a viable cause for a penalty. Even though they didn't produce those pictures by any means, they were in fact in possession of it, it's kind of the same way people who look for and download child pornography can be charged for possession, not just the ones who made it. The ones who were charged with possessing it should have deleted the content when they received it, not have kept it(assuming they did, I don't have all the details on the story you mention in particular). If I were to get an email/text with pictures like that in it, and I did not delete it, then I would consider that a breach of the law on my part. As for if I would ever do it. No way. Mainly because 'sexy' is not a word I would use to describe me and also because I am extremely shy about that stuff. I don't think my girlfriend would appreciate a nude picture of me very much, that's honestly something that can wait until after marriage. Now that my self esteem has been bottomed out again, I think I should get a tub of ice cream, a box of tissues and sit down to watch a soap. (Sexy texting? Now I've done that with my girlfriend.) EDIT: "Come see the whole thing in person" @DA- I believe that calls for a mandatory bow-chika-wow-wow. |

lol, n00dz. I've received 'em before, seen 'em before, etc., no big deal for me, but wow, starting at 12 years? That's something new I learned today. D: As for penalties and punishments and all that, I personally don't really care, and I don't really know the rules on this. I don't really think they should be handled at such a serious matter, cause it's just fun and whatnot, or people are just stupid, but if I guess depending on the people involved, yeah, I think it could be serious and/or more serious matter. Why take a pic of myself n00d? Come see the whole thing in person... nah, just kiddin'. :P ------- |

Lol gendou. xD That stuff is really tacky and embarrasing, in my opinion. Like the Irish government cares about this xDDD But still, it's just eww. I remember one of my friends in school received a pictext message and it was a pic of a man's privates. She was 15 at the time and she was grossed to see that. The guy apparently used the wrong number, so he apologized. In China, the officials will put a ban on sexting (recent news) as most of the source is illegal and lewd. |

Nude pictures of myself are for only one person and not to be sent over a phone or posted to the net. Nude pictures of my children are for no one except family. Yet the law is written so that anyone possessing pictures of naked minors, including family photos, is guilty of child pornography. That includes pictures of my kids when they were babies in the bath. You know, 1-5 years old. Everyone in the world has naked baby pictures. Minors, especially girls who seem to be doing more of this than I first thought, do not need to be prosecuted for kiddy porn. Nor do they need the stigma of being a sex offender for the rest of their lives because if you are found guilty of a sex crime of any kind in the U.S. your name goes into the national sex fiends database where anyone can look it up. Is that the right thing to do to a 14 year old? |

I'm not surprised since sexy is now a trend. you even get to see them on TV adds. so they get to realize a these things at a much more earlier age. and a no , no and no. it would be a considered a scandal in our country if it is distributed to the public. specially if the photo is not of the sender's them selves. not sure of the penalties but it is a crime. but if its just between the persons you know. well... if no body complained I don't think the authorities would care. Its just some thing that is being discouraged. if minors are involved it will be up the persons involved or the parents if they want to file a case. |

The definition of Pornography and what is obscene has been debated, written about and legislated by governments for years. Many high courts have found that if something is considered obscene by an individual it can then be defined as is porn. I find war obscene/ Does that mean it's porn? *giggles* |

Id think the same laws would apply in Australia. However, in saying that, its not fair. Not at all. No, no, no and probably the same penalty everywhere else. Still, its not fair! I mean... these kids probably didnt know any better. Why should teenagers be jailed for, to an extent, NORMAL sexual curiosity? Ok, so, kiddy porn is definitely a no, but is it always the case that its sent with the intention of being a kiddy porn shot? No, not always. To me, thats being framed. Really, though... you could end up having half the country having a criminal record for child pornography! Personally, I found the story you mentioned to be ridiculous! Besides... how were the photos found? I doubt the friends wouldve reported it!! There was an article in the newspaper a few days back now on sexting that I didnt get to read... Ill see if I can look it up... Still... how ludicrous...

While I understand the context and think it's stupid for people to get in trouble for sending nude pics of themselves to their friends, it is technically against the law because it's technically child porn. I would prefer people in these situations be exempt, but I don't think it's enforceable. Child porn is not a joke and the less of it that gets around the better. Once it gets out there, it's OUT there. Depending on who the image was sent to it could easily have been sent to friends, then friends of friends, and so forth. Once it gets out there it's no longer just a private picture--it's public. And that's the difference. I believe people should be able to share that kind of stuff with people in private. But, once it's out there for strangers to find, it officially becomes porn. If someone was found with that kind of stuff on their hard drive, no one is going to see that as "private stuff." They'll see it as child porn which could have easily been sent into the wild. I don't think there's any context that takes precedence over this. Though, I think parents should be allowed to take naked baby pictures. That's just standard fare. You're SUPPOSED to, if only to embarrass them during their high school graduation open house. Also, I don't think those found guilty of such things should be put in the Sex Offender Database. As someone else said, that is a SERIOUS stigma and it's cruel to punish someone like that just for their adolescent stupidity. |

I don't care what anyone says, most 12 year olds know what they're doing when they send that picture out, for the most part. At least I would have, but thank God I never got a cell phone until only recent months because I was going out a lot. I don't think kids should be hit up with the charge of sex offenders for having nude pictures of themselves or other kids their age, which often ends up as a stupid mistake. Laws should be changed about the extent of that, because that messes up people's lives forever for a large bit when they get caught up in such a thing, ever. I agree a lot with Promethius on that subject. Another thing, I think age of consent, for dating anyway, is bull. Screw that. I really don't care much for the subject, but /Highfives Gendou. 1. no and it's a way to get into a lot of trouble 2. NO WAY 3. Cost more and it's pointless 4. What's the penalty i would say it's the BIG HOUSE ._.; and might be a HUGE list of people who done it and to look out for when out. and Sexting is WRONG for teens! |
